Acești termeni reglementează accesul la site-ul bdautomations.ro și utilizarea lui. Site-ul are caracter de prezentare: nu comercializează servicii online, nu publică prețuri și prin intermediul lui nu se încheie contracte. Utilizarea site-ului constituie acceptarea termenilor.

Obiectul termenilor și acceptarea lor

Termenii se aplică oricărei persoane care accesează site-ul, indiferent de dispozitivul sau de canalul prin care ajunge la el. Accesarea și utilizarea site-ului constituie acceptarea lor. Vizitatorul care nu acceptă termenii trebuie să înceteze utilizarea site-ului.

Termenii se aplică exclusiv site-ului. Prestarea serviciilor către o firmă se face în temeiul unui contract de servicii distinct, încheiat în scris; în relația cu clientul, contractul de servicii prevalează asupra acestor termeni.

Natura site-ului

Site-ul bdautomations.ro cuprinde șapte pagini de prezentare și pagina demonstrației pe site-ul firmei, redactate în limba română, cu o versiune în limba engleză accesibilă printr-un buton. Ele descriu ce face un asistent AI pentru o firmă de închirieri auto și în ce constă o prezentare pregătită pe datele publice ale firmei.

  • Site-ul nu comercializează servicii online: nu există coș de cumpărături, plată sau abonament.
  • Site-ul nu publică prețuri. Oferta se transmite în scris, pentru fiecare firmă, după analiza flotei, a regulilor de preț și a canalelor pe care firma primește cereri.
  • Prin intermediul site-ului nu se încheie niciun contract. Formularul și asistentul din chat sunt mijloace de contact, nu comenzi.
  • Site-ul nu creează conturi de utilizator, nu are newsletter și nu pune la dispoziție fișiere pentru descărcare.

Textele descriu serviciul astfel cum funcționează la data indicată în josul acestei pagini. Capturile de ecran, demonstrațiile și exemplele de conversație au caracter ilustrativ; ele nu constituie o promisiune privind performanța, disponibilitatea sau rezultatul serviciului.

Formularul de cerere

Formularul solicită numele, denumirea firmei, un număr de telefon și o adresă de email, iar opțional site-ul firmei și un mesaj. Datele sunt folosite pentru soluționarea cererii și pentru pregătirea prezentării, nu în alt scop.

  • Transmiterea formularului nu creează obligații pentru expeditor și nu duce la încheierea unui contract.
  • Cererea este preluată de Daniel Birsan, fondator și administrator al societății, de regulă în aceeași zi lucrătoare.
  • Prezentarea, atunci când este solicitată, se desfășoară ca o discuție de aproximativ 30 de minute, stabilită de comun acord.
  • Datele introduse în formular trebuie să fie ale expeditorului sau acesta trebuie să aibă dreptul de a le comunica.
  • Formularul demonstrației pe site-ul firmei solicită adresa site-ului firmei și un număr de telefon, iar opțional un email și un nume. Bifând caseta din formular, sau apăsând butonul care pornește demonstrația din confirmarea formularului de contact, expeditorul confirmă că reprezintă firma sau că are acordul acesteia.
  • Demonstrația se pregătește doar din paginile publice ale site-ului indicat, iar valorile pe care site-ul nu le publică sunt completate ca exemplu și marcate astfel. Prețurile și rezervările din demonstrație nu sunt reale și nu angajează nici societatea, nici firma.

Asistentul din chat

Site-ul pune la dispoziție, într-o fereastră din colțul paginii, un asistent care răspunde la întrebări despre ofertă. Asistentul este un sistem de inteligență artificială, nu o persoană, iar răspunsurile sunt generate automat. Informarea vizitatorului cu privire la acest fapt este cerută de Regulamentul (UE) 2024/1689, articolul 50.

  • Răspunsurile au caracter informativ și pot fi incorecte sau incomplete.
  • Asistentul poate înregistra o cerere de prezentare dacă primește denumirea firmei și un număr de telefon sau o adresă de email.
  • În fereastra de chat nu se introduc parole, date de card, date privind alte persoane sau informații confidențiale.
  • Comunicarea cu o persoană este disponibilă oricând, prin formular sau la adresa bda@bdautomations.ro.

Răspunsurile asistentului nu constituie ofertă și nu angajează societatea. Prețul, termenele și condițiile serviciului se stabilesc exclusiv în scris, pentru fiecare firmă.

Cifrele publicate și sursele lor

Cifrele publicate pe site provin din surse terțe, citate lângă fiecare cifră și enumerate pe pagina Rezultate: https://bdautomations.ro/rezultate. Ele sunt reproduse cu definițiile, metodologia și perioada de referință ale sursei originale.

Societatea nu garantează exactitatea, caracterul complet sau actualitatea acestor cifre și nu garantează obținerea unui rezultat similar. Cifrele nu constituie o prognoză, o estimare a veniturilor sau o promisiune privind performanța serviciului.

Deciziile luate pe baza cifrelor publicate aparțin exclusiv persoanei care le ia. Verificarea lor în sursa originală rămâne la îndemâna oricărui cititor.

Drepturi de proprietate intelectuală

Textele, structura paginilor, designul, logoul și codul site-ului aparțin BIRSAN DANIEL AUTOMATIONS S.R.L. sau sunt utilizate de societate în temeiul unei licențe. Paginile pot fi citite, tipărite și citate cu indicarea sursei.

Republicarea, copierea în alt site, modificarea, distribuirea sau utilizarea comercială a conținutului, în tot sau în parte, fără acordul scris al societății, nu sunt permise. Aceeași regulă se aplică numelui și logoului.

Drepturile asupra studiilor și statisticilor citate aparțin autorilor lor; site-ul le citează cu indicarea sursei.

Utilizarea site-ului

Site-ul este public. Următoarele utilizări nu sunt permise:

  • extragerea automată a conținutului, copierea în masă a paginilor sau reutilizarea lor într-un alt produs ori serviciu;
  • încercarea de a accesa serverul, panoul de administrare sau baza de date, inclusiv testarea de securitate fără acordul scris al societății;
  • transmiterea repetată de cereri false prin formular sau prin chat, mesaje automate, spam ori conținut ilegal;
  • orice acțiune care solicită serverul peste utilizarea normală a unui vizitator sau afectează funcționarea site-ului pentru ceilalți.

Formularul, asistentul și contorul de vizite au limite de utilizare pe adresă IP. La depășirea unei limite, cererea este respinsă cu un mesaj de eroare și poate fi reluată după câteva minute. Vulnerabilitățile descoperite se semnalează la support@bdautomations.ro înainte de a fi făcute publice.

În cazul încălcării acestor reguli, societatea poate restrânge sau bloca accesul la site, fără notificare prealabilă și fără a-și asuma prin aceasta vreo răspundere.

Disponibilitatea, modificarea și retragerea site-ului

Societatea depune eforturi rezonabile pentru menținerea site-ului în funcțiune, dar nu garantează funcționarea neîntreruptă sau lipsită de erori. Site-ul poate fi oprit pentru mentenanță.

Site-ul, paginile, textele și funcțiile lui pot fi modificate, suspendate, restrânse sau retrase, în tot sau în parte, în orice moment și fără notificare prealabilă.

Asistentul din chat depinde de un furnizor extern de model. Când acesta nu este disponibil, asistentul răspunde dintr-un set de răspunsuri scrise în prealabil, care rulează pe serverul societății.

Limitarea răspunderii

Informațiile publicate pe site sunt furnizate ca atare, cu bună-credință, fără nicio garanție expresă sau implicită privind exactitatea, caracterul complet, actualitatea sau potrivirea lor pentru un anumit scop.

În limitele permise de lege, societatea nu răspunde pentru:

  • prejudiciile indirecte, oricare ar fi ele;
  • beneficiul nerealizat, pierderea de venituri sau de economii preconizate;
  • pierderea de date, de clientelă, de reputație sau de oportunitate de afaceri;
  • deciziile luate pe baza cifrelor publicate pe site, a textelor de prezentare sau a răspunsurilor asistentului;
  • întreruperile, erorile sau pierderile cauzate de rețelele de comunicații, de dispozitivul ori browserul vizitatorului sau de furnizorii externi folosiți pentru funcționarea site-ului;
  • conținutul site-urilor terțe către care site-ul face trimitere.

Nicio prevedere a acestui document nu înlătură și nu limitează răspunderea pe care legea nu permite să fie înlăturată sau limitată, în special răspunderea pentru deces sau vătămarea integrității corporale, pentru dol sau culpă gravă, precum și drepturile pe care legislația privind protecția consumatorilor le acordă în mod imperativ.

Forța majoră

Societatea nu răspunde pentru neexecutarea obligațiilor sale sau pentru executarea lor cu întârziere atunci când acestea sunt cauzate de un eveniment aflat în afara controlului său rezonabil.

Sunt asemenea evenimente, fără ca enumerarea să fie limitativă: calamitățile naturale, incendiul, războiul, actele de terorism, grevele, întreruperea alimentării cu energie electrică sau a rețelelor de comunicații, indisponibilitatea furnizorului de găzduire ori a furnizorului de model, atacurile informatice și actele autorităților publice. Pe durata evenimentului, obligațiile afectate se suspendă.

Linkuri și servicii ale terților

Site-ul conține trimiteri către surse publice, precum studii și statistici, și către canale de contact, precum WhatsApp sau telefonul. Aceste servicii sunt operate de terți, au termenii și politicile lor și nu se află sub controlul societății.

O trimitere nu constituie recomandare, garanție sau asociere cu serviciul respectiv. Termenii și politicile fiecărui serviciu se citesc înainte de utilizarea lui.

Protecția datelor cu caracter personal

Prelucrarea datelor vizitatorilor site-ului este descrisă în Politica de confidențialitate: https://bdautomations.ro/confidentialitate. Valorile salvate în browser și măsurarea anonimă a traficului sunt descrise în Politica de cookie-uri: https://bdautomations.ro/cookie-uri. Ambele documente fac parte integrantă din acești termeni.

Prelucrarea datelor pe care o firmă client le încredințează societății în cadrul serviciului este reglementată de Contractul de prelucrare a datelor: https://bdautomations.ro/prelucrarea-datelor, anexă la contractul de servicii.

Legea aplicabilă și soluționarea litigiilor

Acestor termeni și utilizării site-ului li se aplică legea română. Părțile vor încerca soluționarea amiabilă a oricărui diferend. În lipsa unei soluții, litigiile sunt de competența instanțelor de la sediul BIRSAN DANIEL AUTOMATIONS S.R.L., dacă legea nu prevede altfel.

Serviciul se adresează profesioniștilor, nu consumatorilor. Dacă site-ul este totuși utilizat în calitate de consumator, drepturile imperative prevăzute de legislația privind protecția consumatorilor rămân aplicabile și nu pot fi înlăturate prin acești termeni, inclusiv regulile privind instanța competentă.

  • Soluționarea alternativă a litigiilor este posibilă prin entitățile înscrise la ANPC și, pentru litigiile online, prin platforma europeană de soluționare online a litigiilor (ODR) pusă la dispoziție de Comisia Europeană, în măsura în care aceasta este disponibilă.

Dispoziții finale

  • Dacă o clauză este declarată nulă sau inaplicabilă, celelalte rămân în vigoare, iar clauza afectată se înlocuiește cu una valabilă, cât mai apropiată de scopul ei.
  • Acești termeni, împreună cu documentele la care fac trimitere, reprezintă întreaga înțelegere privind utilizarea site-ului și înlocuiesc orice declarație anterioară pe acest subiect.
  • Neexercitarea sau exercitarea cu întârziere a unui drept nu reprezintă renunțare la acel drept.
  • Societatea poate cesiona drepturile și obligațiile care decurg din acești termeni în cadrul unei transmiteri a întreprinderii, a unei fuziuni sau a unei vânzări de active, cu păstrarea aceluiași nivel de protecție a datelor.
  • Documentul este publicat în limba română și în limba engleză. În caz de neconcordanță între cele două versiuni, prevalează versiunea în limba română.

Societatea poate actualiza acești termeni. Versiunea aplicabilă este cea publicată pe această pagină, cu data actualizării indicată dedesubt. O modificare importantă este semnalată pe pagina de start înainte de a produce efecte. Continuarea utilizării site-ului după publicarea unei versiuni noi constituie acceptarea acesteia.

These terms govern access to and use of the bdautomations.ro website. The site is presentational: it sells no services online, it publishes no prices and no contract is concluded through it. Using the site constitutes acceptance of the terms.

Scope and acceptance of these terms

These terms apply to anyone who accesses the site, whatever the device or the channel they arrive through. Accessing and using the site constitutes acceptance of them. A visitor who does not accept the terms must stop using the site.

These terms apply to the website only. Services are supplied to a company under a separate service contract concluded in writing; in the relationship with a client, the service contract prevails over these terms.

The nature of the site

The bdautomations.ro website has seven presentation pages and the page of the demonstration on a company's website, written in Romanian, with an English version available through a button. They describe what an AI assistant does for a car rental company and what a walkthrough prepared on a company's public data consists of.

  • The site sells no services online: there is no basket, no payment and no subscription.
  • The site publishes no prices. An offer is sent in writing, per company, after the fleet, the price rules and the channels the company receives requests on have been reviewed.
  • No contract is concluded through the site. The form and the chat assistant are means of contact, not orders.
  • The site creates no user accounts, has no newsletter and offers no files for download.

The texts describe the service as it works on the date shown at the bottom of this page. Screenshots, demonstrations and sample conversations are illustrative; they are not a promise as to the performance, the availability or the outcome of the service.

The request form

The form asks for a name, a company name, a phone number and an email address, and optionally the company website and a message. The data is used to answer the request and to prepare the walkthrough, for no other purpose.

  • Sending the form creates no obligation for the sender and concludes no contract.
  • The request is handled by Daniel Birsan, the company's founder and administrator, normally on the same business day.
  • The walkthrough, when it is asked for, takes the form of a call of about 30 minutes, agreed between the parties.
  • The details entered in the form must belong to the sender, or the sender must be entitled to disclose them.
  • The form of the demonstration on the company's website asks for the company's website address and a phone number, and optionally an email and a name. By ticking the box on the form, or by pressing the button that starts the demonstration from the contact form's confirmation, the sender confirms that they represent the company or have its permission.
  • The demonstration is prepared only from the public pages of the website given; values the website does not publish are filled in as examples and marked as such. The prices and bookings in the demonstration are not real and bind neither the company nor the business.

The chat assistant

The site provides, in a window in the corner of the page, an assistant that answers questions about the offer. The assistant is an artificial intelligence system, not a person, and its answers are generated automatically. Informing the visitor of this is required by Regulation (EU) 2024/1689, article 50.

  • The answers are informative in nature and may be incorrect or incomplete.
  • The assistant can record a request for a walkthrough if it is given the company name and a phone number or an email address.
  • Passwords, card details, data about other people and confidential information must not be typed into the chat window.
  • Communication with a person is available at any time, through the form or at bda@bdautomations.ro.

The assistant's answers are not an offer and do not bind the company. The price, the timelines and the conditions of the service are agreed exclusively in writing, per company.

Published figures and their sources

The figures published on the site come from third-party sources, cited next to each figure and listed on the Results page: https://bdautomations.ro/rezultate. They are reproduced with the definitions, the methodology and the reference period of the original source.

The company does not warrant the accuracy, the completeness or the currency of these figures, and does not warrant that a similar result will be obtained. The figures are not a forecast, a revenue estimate or a promise as to the performance of the service.

Decisions taken on the basis of the published figures are solely those of the person taking them. Checking them against the original source remains open to any reader.

Intellectual property rights

The texts, the page structure, the design, the logo and the code of the site belong to BIRSAN DANIEL AUTOMATIONS S.R.L. or are used by the company under a licence. The pages may be read, printed and quoted with the source stated.

Republishing, copying into another site, altering, distributing or making commercial use of the content, in whole or in part, without the company's written agreement is not permitted. The same rule applies to the name and the logo.

The rights in the studies and statistics cited belong to their authors; the site quotes them with the source stated.

Use of the site

The site is public. The following uses are not permitted:

  • automated extraction of the content, bulk copying of the pages or reusing them in another product or service;
  • attempting to access the server, the back office or the database, including security testing without the company's written agreement;
  • repeatedly sending false requests through the form or the chat, automated messages, spam or unlawful content;
  • any action that loads the server beyond a visitor's normal use or affects how the site works for others.

The form, the assistant and the page counter have usage limits per IP address. Once a limit is exceeded the request is refused with an error message and can be retried after a few minutes. Any vulnerability found is to be reported to support@bdautomations.ro before it is made public.

Where these rules are breached, the company may restrict or block access to the site, without prior notice and without thereby assuming any liability.

Availability, changes and withdrawal of the site

The company makes reasonable efforts to keep the site running, but does not guarantee uninterrupted or error-free operation. The site may be taken down for maintenance.

The site, its pages, its texts and its features may be changed, suspended, restricted or withdrawn, in whole or in part, at any time and without prior notice.

The chat assistant depends on an external model provider. When that provider is unavailable, the assistant answers from a set of answers written in advance, which run on the company's own server.

Limitation of liability

The information published on the site is provided as it is, in good faith, without any express or implied warranty as to its accuracy, completeness, currency or fitness for a particular purpose.

To the extent permitted by law, the company is not liable for:

  • indirect loss of any kind;
  • lost profit, lost revenue or lost anticipated savings;
  • loss of data, of customers, of reputation or of business opportunity;
  • decisions taken on the basis of the figures published on the site, the presentation texts or the assistant's answers;
  • interruptions, errors or losses caused by communication networks, by the visitor's device or browser, or by the external providers used to run the site;
  • the content of third-party sites the site links to.

Nothing in this document excludes or limits liability that the law does not allow to be excluded or limited, in particular liability for death or personal injury, for wilful misconduct or gross negligence, and the rights that consumer protection law grants as mandatory.

Force majeure

The company is not liable for failing to perform its obligations, or for performing them late, where this is caused by an event beyond its reasonable control.

Such events include, without the list being exhaustive: natural disasters, fire, war, acts of terrorism, strikes, failure of the power supply or of communication networks, unavailability of the hosting provider or of the model provider, cyber attacks and acts of public authorities. For the duration of the event, the obligations affected are suspended.

The site contains links to public sources, such as studies and statistics, and to contact channels, such as WhatsApp or the phone. Those services are operated by third parties, have their own terms and policies and are not under the company's control.

A link is not a recommendation, a warranty or an association with that service. The terms and policies of each service are to be read before it is used.

Protection of personal data

The processing of website visitors' data is described in the Privacy policy: https://bdautomations.ro/confidentialitate. The values stored in the browser and the anonymous traffic measurement are described in the Cookie policy: https://bdautomations.ro/cookie-uri. Both documents form an integral part of these terms.

The processing of data a client company entrusts to the company as part of the service is governed by the Data processing agreement: https://bdautomations.ro/prelucrarea-datelor, an annex to the service contract.

Applicable law and dispute resolution

These terms and the use of the site are governed by Romanian law. The parties will attempt to settle any dispute amicably. Failing a solution, disputes fall to the courts at the registered office of BIRSAN DANIEL AUTOMATIONS S.R.L., unless the law provides otherwise.

The service is addressed to businesses, not to consumers. If the site is nevertheless used by a consumer, the mandatory rights under consumer protection law remain applicable and cannot be set aside by these terms, including the rules on the competent court.

  • The Romanian National Authority for Consumer Protection (ANPC): anpc.ro
  • Alternative dispute resolution is available through the bodies registered with ANPC and, for online disputes, through the European online dispute resolution (ODR) platform provided by the European Commission, to the extent that it is available.

Final provisions

  • If a clause is found void or unenforceable, the remaining clauses stay in force and the affected clause is replaced by a valid one that comes as close as possible to its purpose.
  • These terms, together with the documents they refer to, are the entire agreement on the use of the site and replace any earlier statement on that subject.
  • Not exercising a right, or exercising it late, is not a waiver of that right.
  • The company may assign its rights and obligations under these terms as part of a transfer of the business, a merger or a sale of assets, keeping the same level of data protection.
  • This document is published in Romanian and in English. In the event of a discrepancy between the two versions, the Romanian version prevails.

The company may update these terms. The applicable version is the one published on this page, with the date of the update shown below. An important change is flagged on the home page before it takes effect. Continuing to use the site after a new version is published constitutes acceptance of it.
